Burn/Auto Accident Litigation: $4.9 Billion Verdict in Anderson v. GM (General Motors)
On Christmas Eve in 1997, Jo Tigner was riding in a 1979 Chevrolet Malibu with her four friends and their mother, Patricia Anderson. When Ms. Anderson slowed for a red light, she was rear-ended by a drunk driver. The car burst into flames, trapping the five passengers. Ms. Anderson escaped, but her passengers suffered disfiguring burns. The victims sued GM alleging defects in the vehicle’s design caused their injuries. During the 11-week trial, the jury learned that GM executives positioned the Malibu’s fuel tank behind the rear axle to save money, fully aware of its potential to explode in a rear-end collision. The jury ordered GM to pay the victims $4.9 billion, including $107.6 million in compensatory damages and $4.8 billion in punitive damages, making it the largest personal injury verdict in history.

Pharmaceutical Litigation: $51 Million Verdict in Barnett v. Merck
In 2006, a federal court jury in New Orleans, LA., awarded $51 million to Plaintiff Gerald Barnett, a 62-year-old former FBI agent who suffered major cardiovascular damage after taking the drug Vioxx. Robinson Calcagnie, Inc. founding and managing partner Mark P. Robinson, Jr., represented Mr. Barnett in the lawsuit. After a two week trial, the jury concluded that Merck – the manufacturer of Vioxx – failed to warn the public about the cardiovascular risks associated with taking the drug. Mr. Barnett had taken Vioxx to help ease the pain associated with his osteoarthritis, and then suffered a serious heart attack. As a result, he underwent five-way bypass surgery, suffered re-occlusion of his vein grafts, and endured angioplasty and stent surgery. Mr. Barnett sought recovery for his pain and suffering, medical expenses and loss of life expectancy. The jury delivered a $51 million verdict in favor of Mr. Barnett, holding Merck liable for failure to warn the public about the drug’s known health risks. The verdict included compensatory damages, as well as punitive damages to deter Merck from engaging in similar conduct in the future.
